1. Agreement to Terms

By accessing or using Anlyon Relay ("Service"), operated by Anlyon ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content. Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference into these Terms.

2. Description of Service

Anlyon Relay is a cloud-based HTTP queue and messaging service that enables you to:

• Publish and schedule HTTP requests
• Manage message queues with automatic retries
• Configure cron schedules and URL groups
• Monitor and analyze message delivery and performance
• Access dead letter queues for failed messages

The Service is provided through our API, web console, and related tools. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

• Use a strong, unique password for your account
• Notify us immediately of any unauthorized access or security breach
• Not share your account credentials with third parties
• Be responsible for all actions taken using your account

3.3 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit, store, or process any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Send spam, unsolicited messages, or engage in any form of automated bulk messaging
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete with Anlyon or to build a similar service
• Exceed the rate limits or usage quotas associated with your subscription plan
• Use the Service in a manner that could damage, disable, or impair our infrastructure
• Collect or harvest information about other users without their consent

We reserve the right to suspend or terminate your account immediately if you violate these acceptable use provisions.

5. Plans and Billing

5.1 Available Plans

We offer the following plans:

• Free Plan: Includes 50,000 messages per month at no cost, with basic features and usage limits
• Pay-As-You-Go Plan: Usage-based pricing with no monthly base fee. You pay only for the messages you send beyond the free tier limits
• Enterprise Plan: Custom pricing and configurations for high-volume usage (contact us for details)

We reserve the right to modify our plans, features, and pricing at any time, with reasonable notice to existing customers.

5.2 Billing and Payment

Free Plan: No payment method required. The free plan includes 50,000 messages per month at no cost.

Pay-As-You-Go Plan: Billing is based on actual usage. You will be charged for messages sent beyond the free tier limits according to our current pricing (e.g., $0.50 per 200,000 messages). Charges are calculated based on your usage and billed periodically. You agree to provide accurate billing information and authorize us to charge your payment method for all usage fees.

• Usage is calculated based on the number of messages published through our API
• Billing occurs after usage, typically on a monthly basis or when usage thresholds are met
• All fees are non-refundable except as required by law
• If payment fails, we may suspend or terminate your access to paid features until payment is resolved
• You are responsible for any taxes, duties, or fees applicable to your use of the Service
• Price changes will be communicated in advance and will apply to future usage

5.3 Plan Changes

You may upgrade from the free plan to pay-as-you-go at any time by adding a payment method. You may downgrade from pay-as-you-go to the free plan at any time, and you will retain access to paid features until the end of your current billing period. Plan changes may take effect immediately or at the start of the next billing cycle, as determined by our billing system.

6. Data Ownership and Privacy

6.1 Your Data

You retain all ownership rights to the data, content, and information you submit through the Service ("Your Data"). You grant us a limited, non-exclusive license to use, store, and process Your Data solely to provide and improve the Service.

6.2 Data Processing

We process Your Data in accordance with our Privacy Policy. You are responsible for ensuring that Your Data complies with applicable laws and does not infringe on third-party rights.

6.3 Data Deletion

Upon termination of your account, we will delete Your Data in accordance with our data retention policies, subject to legal and contractual obligations. You are responsible for exporting any data you wish to retain before account termination.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its original content, features, functionality, API, documentation, and all related intellectual property, is owned by Anlyon and protected by copyright, trademark, and other laws. These Terms do not grant you any right, title, or interest in the Service or its intellectual property.

7.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in accordance with your subscription plan.

7.3 Feedback

Any feedback, comments, or suggestions you provide regarding the Service may be used by us without restriction or compensation to you.

8. Service Availability and Support

8.1 Service Level

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Support

Support is provided according to your subscription plan. We will make reasonable efforts to respond to support requests in a timely manner, but we do not guarantee specific response times or resolution of all issues.

8.3 Service Modifications

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that may affect your use of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• IN NO EVENT SHALL ANLYON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Anlyon and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit through the Service

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. For pay-as-you-go accounts, you will be charged for any usage incurred up to the termination date. Termination will be effective immediately, and any pending charges will be processed.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy
• You fail to pay fees when due
• You engage in fraudulent or illegal activity
• We discontinue the Service (with reasonable notice)

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. For pay-as-you-go accounts, you will be charged for any usage incurred up to the termination date. We may delete Your Data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, limitations of liability, and payment obligations for usage prior to termination.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution Process

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive any right to a jury trial or to participate in a class-action lawsuit.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Anlyon regarding the Service and supersede all prior agreements and understandings.

13.2 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

13.5 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
